Workplace Safety & Workers' Compensation

Protecting the safety of your workforce is, undoubtedly, one of your primary concerns as a responsible employer. Maintaining a safe working environment, however, has gotten more complex as the landscape of today’s workforce has changed. Compliance with myriad federal and state regulations that protect a worker’s right to a safe work environment can be a challenge to employers. Porter Wright can help.

We have the broad-based experience to assist you in complying with these overlapping regulations concerning workplace safety, workplace violence, and workers’ compensation. We work with clients in the manufacturing, construction, transportation, mining, industrial, and service sectors throughout Ohio and across the country to address these important issues.

In the workers’ compensation arena, we work with both self-insured and state-fund employers to reduce the risks of workplace injuries and diseases and to return injured and ill employees to the workplace as quickly as possible. In addition, we can help you contest invalid claims, investigate circumstances of suspected abuse and fraud, and manage your company’s ratings and premiums. Our attorneys are equally skilled and experienced handling administrative filings and proceedings with the Bureau of Workers’ Compensation and the Industrial Commission as they are working in conjunction with third-party administrators that handle those tasks. And, when workers’ compensation issues reach Ohio courts, we rely on our extensive litigation experience to aggressively defend your interests.

In the fields of OSHA and MSHA regulation, we work first to prevent problems by offering advice regarding health and safety initiatives and obligations and by conducting appropriate policy and procedure audits to identify possible weaknesses in your workplace safety plan. We also protect your interests during OSHA inspections and work to favorably resolve OSHA citations. When litigation is unavoidable, we provide aggressive representation to minimize liability and business disruptions. When serious injuries or fatalities occur, our attorneys can be on-site immediately to help you communicate with employees, the media, and government representatives; to perform a privileged investigation of the incident; and to recommend and implement appropriate corrective and preventative measures.

Our services include:
- Advice and consultation
- Privileged accident investigations
- Representation before the Bureau of Workers’ Compensation and the Industrial Commission
- Representation before OSHA and MSHA
- Resolution of administrative health and safety citations
- Defense in trial and appellate courts
- Assistance with assessments, audits, and ratings issues
- Educational seminars
- Defense of Violation of Specific Safety Regulations (“VSSR”) claims
- Intentional tort lawsuits
- Assistance in managing your overall workers’ compensation program and decreasing your workers’ compensation costs
