Garvin & Hickey works closely with company personnel and their Third Party Administrators to reduce workers' compensation costs. Most clients and their TPA's utilize the Firm's experience by seeking advice on certification of claims, defense strategies, returning employees to work, use of rehabilitation consultants and settlement of claims. Garvin & Hickey represents employers at all administrative hearing levels of the Industrial Commission and also in jury and non-jury trials in all Ohio counties. The Firm has extensive experience in the Courts of Appeals and the Supreme Court of Ohio.
The Firm's representation includes not only the defense of injury and occupational disease claims but also the defense of violations of specific safety requirements and intentional tort actions. The Firm has represented employers in defense of OSHA citations and wrongful discharge actions arising out of industrial injuries.
Self Insured Workers' Compensation
Garvin & Hickey has extensive experience in assisting employers in successfully transitioning from the State Insurance Fund to a Self-Insured Worker's Compensation program. Both principals of the Firm have completed the certification requirements for establishing a Qualified Health Plan which is is required for all employers desiring to become self-insured. The majority of the Firm's practice is in Ohio. However, Garvin & Hickey has conducted audits of clients workers' compensation programs in other states. Such audits include a review of work being performed by in-house personnel as well as the TPA and outside counsel. Matthew D. Shufeldt began his workers' compensation career in 1986, working for third party administrators, actively participating in the administration of claims. In 1998, he earned a Bachelor of Arts degree from The Ohio State University. In 2000, he earned a Juris Doctor from Capital Law School. He was admitted to the practice of law in 2001.
Since 1992, Matt has been representing a variety of large and small companies, both state funded and self-insured, before the BWC and Industrial Commission. Since 2001, Matt has represented claimants and employers before the administrative agencies and the trial and appellate courts of Ohio. Because he has spent time representing claimants, he has unique perspectives and insights into the workers' compensation system and claims management strategy.
Matt is admitted to practice in the state courts of Ohio and to the Federal District Court for the Southern District of Ohio. He belongs to the Columbus Bar Association and the Ohio State Bar Association. He is actively involved with the National Center for Adoption Law and Policy, at Capital University Law School. In 2004, Matt was nominated by the most recent group of "Super Lawyers" and named a "Rising Star" among Ohio's lawyers, by Law & Politics Magazine. This distinction is awarded to approximately 2.5 percent of lawyers in Ohio, who are under the age of 40 or in the practice of law for less than 10 years.
